Will You Qualify For The $28M SiriusXM Settlement? – AfroTech

SiriusXM Radio has agreed to settle a $28 million lawsuit.

Lawsuit Explained

Plaintiffs filed a class action lawsuit against the satellite radio company, alleging it violated the Telephone Consumer Protection Act (TCPA) by calling consumers listed on the National Do Not Call Registry or after consumers told the company they did not want to be contacted, USA Today reports.

The lawsuit was filed in November 2022 in the U.S. District Court for the Central District of Illinois according to Inside Radio.

The TCPA prohibits automated calls to individuals on the Do Not Call Registry unless the individual has given prior permission. Companies that violate the law can face penalties of up to $500 per call and as much as $1,500 per call for deliberate violations, according to the outlet

Settlement Details

SiriusXM did not admit wrongdoing but agreed to settle the lawsuit for $28 million in October 2025, citing efforts to reduce costs, distractions, and uncertainty if litigation continued, per Inside Radio. In the settlement, SiriusXM agreed to adjust consumer communications and vendor compliance in alignment with telemarketing laws.

The settlement fund will cover attorneys’ fees, administrative costs, and service awards for class representatives before making pro rata distributions to eligible class members, per the outlet.

Who Qualifies

U.S. residents who received more than one telemarketing call from SiriusXM between April 27, 2019, and Oct. 31, 2025, qualify for the settlement, reports USA Today.  These calls must have occurred more than 31 days after the individual joined the National Do Not Call Registry or requested to be added to SiriusXM’s internal “do-not-call” list.

Where To File

You can file a claim on the settlement fund’s website. The deadline to file is March 21, and there is an additional six-day window for objections to be filed.

Approval from the court is still required before payments can be distributed. A hearing is scheduled for May 11, according to USA Today.
