Black Diamond Power requests dismissal of possible PSC probe


CHARLESTON, W.Va. (WVVA) – Black Diamond Power Company has formally asked the state Public Service Commission (PSC) to dismiss a case related to a possible investigation into service, prices and billing issues.

The request was filed Monday with the PSC and said the company has seen an increase in informal complaints but after review found no unusual or irregular billing practices, and all rates and charges have been applied in accordance with its PSC approved tariff.

In the request for dismissal, the company said it has received only five formal complaints alleging billing issues since 2015, and only two recent formal complaints pending before the PSC on unrelated issues.

One complaint alleged power surges at a place of business in Clay. The company said a transformer serving that business has been replaced, resolving the issue.

The other formal complaint involved the Wyoming County Board of Education and an $80,000 price to initiate electrical service at a new school. Last week, that issue was sent to mediation with both parties in agreement, but on Monday the PSC said it is not appropriate for mediation and will go through the normal PSC procedures to consider.

Black Diamond said in the request its management is “neither grossly inefficient nor willingly unresponsive” and, if the investigation proceeds, will cooperate fully with PSC staff.

The PSC legal staff recently recommended an investigation after numerous informal complaints were received and after a request from state Senators Rollan A. Roberts and Brian Helton.

Raleigh County- based Black Diamond, which has been in business for more than 100 years, purchases electricity wholesale and sells it to customers in Clay, Raleigh and Wyoming counties.
